Capacity transfer procedure1. The transferring of a capacity delivered to a legal entity or natural person to another legal entity or natural person due to a change of ownership of a previously connected power receiver shall be possibly only upon availability of documents to confirm a title to the connected power receiver. In order to have a capacity transferred an application shall be sent to the address of a grid company power receivers are connected to.The application shall contain: A description and location of power receivers (non-movable assets). The maximum (permitted) capacity value to be transferred. Upon receipt of an application, a grid company shall review presented documents within 1 month, execute and send to the address of an Applicant a Certificate of definition of financial and operational responsibility. Upon the bilateral signing of the Certificate of definition of financial and operational responsibility the Applicant may contact a Power Sales Company to conclude an electric power purchase contract. Moreover, a claimed capacity value shall not exceed the maximum (permitted) capacity value specified under the Certificate. 2. The transferring of part of a capacity previously delivered to a legal entity or natural person to another legal entity or natural person shall be possible upon availability of a written consent of a person the capacity has been previously delivered to. Consent shall be of optional form. Consent shall contain: Information on a facility – description and address. Transferred capacity value; Capacity transfer grounds; Name of a transferee. In case of capacity transfer from a legal entity, an authorized person's signature shall be certified by a company's seal. Upon receipt of consent, the Applicant shall send a technological connection application to a grid company, with a capacity transfer consent enclosed. Standard transfer documents (complete list) The following documents shall be enclosed with an application: - Copies of charter documents of a legal entity (or copies of identification documents of a natural person) submitting an application, copies of certificates of legal entity's registration, and taxpayer certificates; - Copies of certificates of state registration of titles to real estate and grid facilities; - Copies of documents (contracts) confirming a purchase (sale) by an applicant of titles to real estate and/or grid facilities; - A layout of facilities purchased by an applicant and covered by a capacity transfer application; - Copies of Certificates of definition of financial and operational responsibility confirming technological connection of power receivers and maximum (permitted) capacity value, and other supporting documents. Requirements to execution of documents In accordance with FTS Order of 23.10.2007 No. 277-e/7 On Approval of Guidelines for Calculating the Charge for Technological Connection to Electric Power Grids, the technological connection charge shall be collected one time. Change of a form of ownership or owner (Applicant or Power Grids) shall not result in an additional technological connection charge. In order to transfer a Certificate of definition of financial and operational responsibility a new order shall submit: 1. Documents confirming a maximum (permitted) capacity value for a previous owner. 2. Previous facility owner's agreement for the transferring of part of a capacity (in case of the transferring of part of a capacity). In addition, the following information shall be submitted: For companies (legal entities): 1. A copy of a certificate (decision) of a state registration (full name, registered address, registering authority). 2. A director, authorized person (full name, position), authority (charter, power-of-attorney). 3. Copies of documents confirming rights of use of premises (facility, land). 4. A bank details and company's actual location certificate signed by the director and senior accountant. 5. A copy of a tax registration certificate with TIN. For natural persons: 1. A passport presented for verification of data and actual residential address. 2. Copies of documents confirming rights of use of premises (facility, land). 3. A power-of-attorney entitling a bearer to take certain steps (when applicable). |
